Loitering Arrest of Panhandler Is Dismissed as Unlawful by Fernando Santos - NY Times

A homeless panhandler arrested for loitering after asking a police officer for a dollar won a legal battle on Wednesday when a City Court judge dismissed the charge, finding the arrest unconstitutional.

In doing so, the judge also threw out a misdemeanor drug possession charge against the man, Eric Hoffstead, since it resulted from a search after the unlawful loitering arrest.

With his hands cuffed behind his back, Mr. Hoffstead turned his head upward and smiled as the decision was announced by Judge Preston S. Scher, who presided at the hearing. The decision was signed by Judge Gail B. Rice.

The four-paragraph decree echoed a 1992 ruling by a federal District Court that the state loitering law violated the First Amendment protection of free speech.

Mr. Hoffstead, 36, had urged his court-appointed lawyer, Carl D. Birman, to challenge his arrest after reading a newspaper article about the law. “This is a great victory for freedom of speech,” Mr. Birman said after the hearing.

A spokesman for the Westchester County district attorney, Janet DiFiore, said she did not plan to appeal the decision.  Mr. Hoffstead, who has been jailed 20 times in Westchester County on misdemeanor charges, remains in custody on a trespassing charge stemming from an arrest on May 22. He is due in court on Friday.  The state penal code holds that a person is loitering if he “remains or wanders about in a public place for the purpose of begging.”

The 1992 federal ruling outlawing that provision came in a case that originated in New York City and applied specifically to enforcement in the city. The provision remained in effect for the rest of the state, and nearly 2,400 people statewide have been charged under the statute in the past decade. Legal experts say the 1992 ruling is not binding on state courts but could be a strong precedent when judges hear a constitutional challenge.

The New York Police Department issued 791 summonses from June 23, 2005, when a federal judge in Manhattan ordered it to “cease enforcement” of the provision, to Feb. 21, 2007. That enforcement is the subject of a contempt-of-court motion filed by Matthew D. Brinckerhoff.

No To Liquid Coal

It amazes me that with all of the scientific evidence on global warming, that I even have to write you, asking you to tell Congress to do the right thing. But unfortunately, some members of Congress are still pushing so-called solutions that take us in the wrong direction. New energy legislation in Congress could include liquid coal, which is about as energy-efficient and practical as it sounds. Think of it as turning a hybrid into a Hummer.

We've reached a turning point in history, and global warming is not a political game to be played in the back rooms of Congress. It's time to look past corporate interests and do the right thing - for the nation, and for the planet.

Tell Congress to make the right moves, right NOW.

NOSB Votes Clones and Their Progeny out of Organics

On March 29, The U.S. Dept. of Agriculture's Nat'l Organic Standards Board (NOSB) voted 12-1 to prohibit progeny of clones throughout organic production. It was said that the outcry from the organic industry was "deafening," so thanks to all those involved in this effort. Major industry players like CCOF certified Humboldt Creamery, Dean Foods, Straus Organic Creamery, CCOF Supporting Member Whole Foods, CCOF Supporting Member Organic Valley, Aurora Organic Dairy, and Horizon Organic were among those carrying major weight in this food fight.

 

It is now recognized that cloning as a production method and animal clones are incompatible with the Organic Foods Production Act (OFPA) and are prohibited under the National Organic Program (NOP) regulations, although the NOP still needs to approve this recommendation. More

 

Organic Red Wines are Even Better for Your Health

A new study published on The Organic Center website finds key differences between organic and conventional red wines after examining 15 different red wines, looking at levels of polyphenolic compounds, resveratrol, antioxidant activity, and orhratozin A (OTA) contamination.

The study found that among the 15 varieties of red wine, organic wine had the greatest concentration of antioxidant activity and of the key antioxidant resveratrol, as well as the highest level of total polyphenols. You’re Never Old Unless You Believe You Are By Jackie Lee

 

Having been born with physical challenges shaped my life as it inspired me to find answers and to become as capable and active as others who did not share these challenges.  Because I lived on a farm in a remote area, there were no medical facilities available – even if the knowledge had been.  This has become a lifelong quest since new challenges have a way of turning up, just when you believe you are ahead of the game.   The good news is that science is continually discovering new technology to aid us in this effort – and much of this is now aimed at slowing or reversing the aging process.

     

In spite of pernicious anemia, migraine headaches, a severe thyroid deficiency and Reynaud’s syndrome, as a teenager I became an active member of a traveling gymnastic team in college which performed at various high schools around the state.  I have been able to retain much of this training, still able to perform cartwheels, headstands and balance positions, which motivated me to become a certified yoga instructor in 1999, even though I was well past 60 years of age.  More proof that if you were once capable, you can maintain this capability, regardless of age.  At the ripe old age (for body builders) of 47, I became a competitive body builder and competed for six years in another state before moving to California.  Seven years ago I decided to begin competing again – and again I am the oldest “girl” in each contest.  Even though bodybuilding is a young person’s sport and there will always be age discrimination, there are 3rd, 4th and 5th place trophies, and to date I have won over 40 trophies.  However, the best awards have been the people who came up to me at the contests to tell me that I have inspired them to change their lives, either because they have lost  weight, begun an exercise program, or started walking again.  Even young people tell me that they are motivated to continue exercising for as long as they are able, because they now realize that age sets no limitations.

In addition to body building, I am a personal trainer – focusing on older adults and those with challenges, a yoga instructor, a motivational speaker and I sing with an award-winning choir which received a standing ovation and three curtain calls at Carnegie Hall in 2005 as well as performing as back-up singers in Gladys Knight’s movie.  When I speak, I begin with an acrobatic dance, then relate my experience in Detroit when I was thrown out of my car at 90 m.p.h., feet first into three lanes of oncoming traffic by a carjacker, but was able to jump up and chase him after he totaled my new car.  This is my proof that injuries can be overcome if you are determined and you can return to your previous capabilities.  I have also been a member of an acting class for over 10 years, which performs twice annually, once for friends and family members and once for a convalescent home.  We act, sing, and dance, writing most of our material, thus keeping ourselves flexible, mentally and physically.  Most of us also go out on auditions for roles in movies and commercials, proving again that age is only a state of mind. One of the members of this class is 93, and he writes his own jokes!  Another lady is in her mid-80s and still sings with a beautiful voice.  You are never old unless you believe you are.

 

My advice is to continue to do whatever it is you do, find new directions to expand your capabilities, always follow your dream, and inspire others to do the same. You can be a wonderful example just by being yourself. You never know who will be motivated just because you were brave enough to continue something that others would have decided they were too old to even think of.  I forgot to mention that I am also an award-winning poet, having been published several times, and was nominated for a poet-of-the-year award recently.  I have been writing poetry since I was a child.  And I paint designs on fabric, decorating clothing for myself as well as for gifts for others.  There is no limit to your dreams – hitch your wagon to a star and begin climbing!  They sky is indeed the limit! L.A.’s Water Supply at Risk By Zuma Dogg

As you may know, the City of Los Angeles is on a mission to create massive amounts of high density housing to accommodate all the new residents migrating to this international jewel of the region. But some folks have recently brought it to my attention that the issue of providing water to all these new homes is a serious issue to be considered, which Villaraigosa and City Council ARE NOT considering. Because they take an "analytical" approach to planning, not "holistic". In other words, they just approve project after project; evaluating the project's impact, as if it's the only 40 story condo going up in town -- failing to consider the other 40 story condos being built right next to it.

 

AND -- AS DAILY NEWS HAS NOW BROUGHT TO OUR ATTENTION -- YOU CAN'T BASE YOUR WHOLE FUTURE ON THE FAULTY PREMISE THAT YOU CAN GENERATE AN ENDLESS SUPPLY OF WATER, LIKE IT'S A NUCLEAR GENERATOR !  (DUH!!!!)

 

That is why the City Charter has made the proper provisions to make sure we don't end up in these messes. BUT, the City ignores the Charter and Planning recommendations and other laws -- day after day, week after week -- and now you can add "risky water supply" to homeless, gridlock traffic and LAUSD crisis to your list of things that came back and bit you in the butt, because you ignore things too long -- AND YOU KNEW THIS IS A PROBLEM!   © Zuma Dogg

 

Organic Beehives Remain Intact

Concerns deepen about our nation's honeybee losses and the affliction now known as Colony Collapse Disorder (CCD), but what is actually happening to our honey bees still remains a mystery. The good news is: the organic beekeeping world is not currently reporting any losses, according to an organic beekeeping list of about 1,000 people, mostly Americans, which further deepens the debate. One organic beekeeper reports that his losses stopped when he switched over to natural sized cells. The media has failed to cover the fact that the dying bees are actually hyper-bred commercial varieties coaxed into a larger body size, starved out due to feeding them artificially and moving them great distances, creating major stress for the bees and their hives. The bees seem to have reached a biological limit, or triggering agent, which is why CCD seems to have happened out of the blue. Studies are now focusing on determining weather GM crops, lethal to sub-lethal pesticides, parasitic mites, a parasitic fungus, or cell phone radiation could be the cause of severe losses of honeybee hives across the nation. Approximately 140 billion commercially raised honeybees are responsible for pollinating about $20 billion worth of crops in the United States, and as many as 700,000 of the 2.4 million bee colonies have been affected. Laguna Farm is hosting a summer internship program focused mainly on Alternate Energy. I am continuing with the bio-fuels work and adding fuel saving device work ( water-injection/ hydrogen booster etc) and a big plan to build a methane digester to fuel the veg-generator with bio-gas. I am setting up a summer camping area with rustic kitchen setup and solar shower bathhouse. Miscikoswki and Ring By Therese Dietlin

Cindy Miscikowski was the un-elected and termed-out councilperson for District 11, which includes Venice, since redistricting following the 2000 census. She became the councilperson for Venice in 2002, when it was moved from District 6 over strong opposition from the residents. The new District 11 includes West LA, Venice, Marina del Rey and Westchester. All of these neighborhoods objected to Cindy Misickowski. In a meeting of around 1000 residents with the Redistricting Commission held at WLA Daniel Webster School on Feb 23, 2002, 75% expressed their opposition to Cindy Misickkowski. The same sentiment was expressed by residents of Westchester, Venice and Marina del Rey. All felt she could not represent them in their current disputes with both the city and the developers with controversial projects in their areas. The Committee, consisting of Jack Weiss, Jan Perry, Dennis Zine, Nick Pacheco and Eric Garcetti, voted to recommend approval of the plan anyway.

Objections centered around two main areas: Cindy Miscikowski was not elected in these neighborhoods and there would be no new election until 2005, leaving the residents essentially disenfranchised. Cindy Miscikowski was serving her last term and was a lame duck Councilperson. She also showed herself to be pro-development at the expense of existing communities. She is the wife of Doug Ring of The Ring Group, a development investment company with interests in LAX, Marina del Rey and the much opposed Playa Vista Project. Mr. Ring is the Marina landlord with one of the worst records for maintenance and tenant complaints. (See Ring’s Marina Go-Round, LA Weekly, June 4-19, 1999) He has been sued multiple times by tenants but claims not to have been informed about any of them. His claim to the lease on the property is equally suspect and has been used successfully to dismiss a suit brought by Ring against a tenant. Mr. Ring also has interests in the current projects to expand and upgrade LAX which are opposed by the neighboring communities. His interests in the Playa Vista project are also of concern. Mr. Ring has been a major campaign contributor to the local political machinery for years. As a lobbyist with Mitchell, Silberberg & Knupp from 1993 to 1996, Doug Ring gave $2,500 contributions to District Attorney Gil Garcetti twice (8/93 and 8/95). Mr. Garcetti is father of current Council 13 representative Eric. Mr. Ring also gave thousands of dollars to several County Supervisors during that time. While with the company, he paid it $10,000 to represent his own Marina properties, essentially paying himself. By 1996, Ring was billed by the LA Times as “one of the city’s premier insiders” and “one of City Halls highest paid lawyer-lobbyists.”

 

Mr. Ring has given thousands of dollars to several Hahn campaigns, including $10,000 to the campaign opposed to Valley secession. Misickowski was “the council’s most virulent opponent of secession” (report from citizens’ group on secession). In a political deal, she agreed to support Alex Padilla’s bid for Council President and Mr. Padilla, in return, replaced Councilperson Hal Bernson with Cindy Miscikowski to represent the city of LA on the Local Agency Formation Commission responsible for setting the terms for separation if the bid for secession was successful. As added incentive, Doug Ring arranged for part of the proposed new Children’s Museum to be located in Padilla’s district at Hansen Dam. This move was adamantly opposed by Valley residents who were also opposed to Miscikowski’s support of a garbage dump in Sunshine Canyon. Likewise, the residents of Malibu objected to her support of expansion of the Getty on PCH, while she has taken campaign contributions from the Getty Trust.

 

Doug Ring has been part of the revolving door scene, serving on the Board of the Redevelopment Agency (until 2003, when he resigned and the city council named a replacement), the Los Angeles Homeless Services Authority, and several other trustee positions where he was responsible for the decisions that he would also benefit from. Citizen attempts to file complaints with city commission about objectionable practices or projects have been met more than once by the caveat that while the commission would take their complaints, Doug Ring was a member of the very Commission or Board they were complaining about.

Update on Venice Boardwalk & LAMC 42.15

On Thursday, May 24, 2007, US District Judge Pregerson held a settlement hearing to discuss two lawsuits, Venice Food Not Bombs v. City of Los Angeles and Hunt & Dowd v. City of Los Angeles, regarding the constitutionality of LAMC 42.15. The tentative settlement proposal discussed how “to resolve the disputes in a way that retains the historic character of Venice Boardwalk as a forum for the free exchange of ideas and for the celebration of expression through artistic displays and performances.”  The judge put forward his ideas on how the City should proceed, as follows:  

 

I.   "Performance/Political Speech" Zone

- The City will designate a zone in the middle of Venice Boardwalk as a "performance/ Political Speech" zone. This zone will be located south of Dudley and north of Muscle Beach.

 

- Performance artists may perform in this zone, "Speakers" e.g. political protestors, religious speakers, may also communicate their messages in this zone.  The City will designate spaces in this zone to accommodate "fixed" performers and speakers.  Spaces for performance artists will be distributed to prevent crowding.

 

- The City will also designate spaces in this zone for musicians to perform. These musicians will be permitted to sell recordings of the songs that they are performing in this zone.  They may not, however, sell any other goods in this zone.  This provision is an attempt to distribute the noise level evenly along Venice Boardwalk. Aside from the musicians' recordings of their performances, only books, buttons and bumper stickers will be sold in this zone.  This provision is an attempt to distribute the noise level evenly along Venice Boardwalk.

 

- Individuals in this zone may accept donations. However, if the City believes that an individual is actually selling non-exempt goods as opposed to accepting donations, the City may bring a civil lawsuit to enjoin those sales.  The City will not arrest or ticket individuals for selling non-exempt goods in this zone. Individuals may give away items - regardless of whether the items are exempt form the ban on sales - on any part of Venice Boardwalk.

 

II.  "Inextricably Intertwined" Zone

-  The City will designate two zones for vending at the ends of the Boardwalk.  The first zone will be located on the Boardwalk south of Navy and north of Dudley. The second zone will be located in the Windward Plaza area.

 

-  These zones will be designated for the sale of products that are "inextricably intertwined" with speech.  This means that individuals can sell goods in these zones that they believe have a "speech" component.  The City will post a notice in these zones that communicates this requirement.

 

- Individuals will participate in a lottery to obtain a designated space for the sale of their goods in these zones.  The City will create additional vending spaces in these zones to compensate for the absence of vending space in the "performance/political expression" zone.

 

-  If the City believes that an individual is selling goods in these zones which are not "inextricably intertwined" with speech, the City may bring a civil lawsuit against that individual to enjoin the sale of those goods.  The City will not arrest or ticket individuals for selling goods that the City believes lack a speech component.

III.  Noise Regulations

- The noise regulations are currently being reviewed in an effort to create regulations that will apply uniformly to the east and west sides of the Boardwalk.”

2nd Amendment?  By W. George E. K. French

 Every time somebody starts in on the Second Amendment, it drives me up the wall.  They go into all sorts of crap about this and that, but they always skip over the important part, and try to confuse the issues with the rest.  For the sake of the sanity of us all, let’s take a clear look at it.  “A WELL REGULATED MILITIA, BEING NECESSARY TO THE SECURITY OF A FREE STATE, THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS, SHALL NOT BE INFRINGED.”  

First of all, the part they always skip over completely is the word militia.  They’ll tell you that this means the National Guard.  NO DAMNED WAY !!!!  Now I think it’s interesting that the meaning of the word militia is exactly the same as it was in 1776.  If you go to a library, dig out some old dictionaries that were printed back then,   you will find the definition of militia was exactly the same then.  National Guard is paid by the Federal Government, or in some cases, the State Government. MILITIA IS NOT PAID BY ANYONE!!!  National Guard wears Official Government uniforms, carry weapons provided by Government, and all equipment is provided by government.  Government commands the National Guard to do this or that, and they serve for a specified term, as do regular Army enlistees.             

Militia is private citizens, banded together for the common defense. They have and carry their personally owned weapons and ammunition.  If a militia wears some sort of a uniform, it’s because they themselves have provided it.  They don’t work for a Government.  They are of the People, to protect the People, and their country from enemies who would impose their rule upon the People. Back in the days of the Founding Fathers, our militia people fought against the “duly constituted Government of the British Crown” for our freedom. They used whatever weapons that they had.  Guns were few, but rakes, scythes, clubs, rocks, and bows and arrows were available.  That war against the British was brutal and savage.  The British had no shortage of rifles, cannon, bayonets, and so forth.  The Founding Fathers concluded that never again should our People be without the means to protect themselves, or to throw off any yoke of oppression by anyone, including “duly constituted Government.  Government does not own THIS land, we, the People do!           

WE, the People, grant the representatives of us all the right to keep order, to form armies, formulate law and tariffs for our common protection.  Sometimes these “representatives” tend to feel that they are our superiors, our rulers, and they do not wish us able to protect ourselves from their thievery, or want us able to observe what they do in secret to enslave us.   These are the acts and the desires of men who would like to become our masters, not our representatives.  We cannot allow them to force us into servitude.  They may NOT disarm us, or act in secret against our best interests, unless we are stupid enough to let them get away with it. The time may be close at hand when we, the People, will have to stand up for our rights, and fight against the inroads of a Government which would destroy every right we possess, and leave us all in bondage of the very worst sort.   

The Second Amendment gives the People the right to keep and bear arms. It imposes no limits as to when or where this right may be exercised.  No local law, statute, executive order or ruling of any sort has the .legal ability to limit this right.  The Constitution is the supreme law of this Nation, as decreed by the People, who are the rulers of this land, rather than a “Government.”  The Government only acts for OUR protection, not that of itself.  If we are foolish enough to allow government to act to protect its own interests over those of We, the People, we will soon have no interests, no rights, no freedoms, and no future as a free People. 

Keep your squirrel rifles handy, boys, you might have a use for them mighty soon, and I don’t mean for shooting four legged varmints, but more likely for those two legged critters who think they own us all.  We may have to show them that they don’t own us, much as they would like to.  One more thing, if I may.  A privilege can be either given, or taken away.  A right CANNOT be taken away.  The birthright of We, the People, is the right to keep and bear arms for our own protection, and that includes protection against a government gone rogue.  It begins to look as if our present government might fit this description. © W.
